General Terms & Conditions

Blue Marble Office will not be held accountable if delays are from the client’s end; however, Blue Marble Office will work with you to ensure that deadlines are as achievable as possible.

Blue Marble Office will work with you with the highest level of integrity and confidentiality. We ensure that no information is disclosed to any additional parties without prior consent.

All work will be kept on file for a period of 6 months. After this time, work will be deleted unless specifically instructed.

We use encryption services for necessary passwords and any other sensitive data. If the client chooses other distribution methods Blue Marble Office is not responsible for any risks this could entail. 

Blue Marble Office Virtual Assistants are assigned to work on a virtual basis only.  ‘In person’ work may be possible in exceptional circumstances but cannot be guaranteed. If granted, all hours including travel time to and from the work location, as well as hours spent on the job, are billable with no exceptions.

If it’s required to Blue Marble Office to send emails on your behalf, then it is a requirement for you (the client), to provide an email account to act on your behalf.

At the end of tasks, content done by Blue Marble Office is owned by your company. Blue Marble Office does, however, have the right to showcase any non-confidential work as a case study.

If the client provides any kind of material, the client will be solely responsible for any violations of copyright law and may be subject to legal sanctions.

Blue Marble Office has the right to deny any task asked by the client if they consider it engage in any illegal or immoral activity.

The tasks will be performed by the members of Blue Marble Office staff. Rare circumstances may involve the Blue Marble Office staff to require help from third parties.

In the case of the assigned assistant for your project gets sick, Blue Marble Office will be in charge to assign a substitute until your assistant is able to take the project again.

The assigned Virtual Assistant could be allowed to take vacation leave. In those circumstances, Blue Marble Office will inform you 7 (SEVEN) days in advance and discuss potential conditions.

The client will not be responsible for the Virtual Assistant’s sick leave, retirement benefits, worker’s compensation, health or disability benefits, unemployment insurance benefits or employee benefits of any kind.

If 7 days pass without a response, Blue Marble Office will assume the client is happy with the final result and will proceed to invoice if any invoices are still pending.

the client has 14 days to make the payment effective after the invoice is sent, if nothing else instructed. After those 2 weeks 5% fees are added. PayPal fees or any other transaction fees are not included in the price of service.

If any additional costs apply, the client will be charged separately to the package in the same invoice. After the additional cost is billed, the client will have 14 days to make this payment effective.

The client has to make the first service’s payment effective if decides to hire more services from Blue Marble Office if nothing else has been previously instructed.

If 24 hours deadline for a task is requested, additional charges may be applied.

Regardless of the client’s currency, all invoices and payable charges for the services conducted will be paid in US dollars.

The client allows Blue Marble Office to add a review (if provided), company logo and any relevant information to Blue Marble Office Website and/or Social Media pages.

Your Virtual Assistant acts under your direction. If you require your Assistant to make decisions on your behalf about the way in which any work/ actions/ tasks/ strategies or other business related functions are performed, you do so on the basis that the assistant is acting on your behalf and is under your supervision at all times.


Pay as you go package:

Package validity: 30 days from the day of the package purchase. All the tasks will be performed after the package payment is done and briefing form received. This service will be billable per month. 

No refunds will apply in this package.



Silver package:

Package validity: 30 days from the day of the package purchase. All the tasks will be performed after the package payment is done and briefing form received. Unused hours are not rolled over to the following month.

The agreement is valid from the first day of payment and throughout for length of days, the services are requested. 

No refunds will apply in this package.



Gold package:

Package validity: 30 days from the day of the package purchase. All the tasks will be performed after the package payment is done and briefing form received. Unused hours are not rolled over to the following month.

The agreement is valid from the first day of payment and throughout for length of days, the services are requested.

In the unlikely case the client is not happy with the quality of the services provided, the client can request a 50% refund. The refund applies only when the work done by Blue Marble Office didn’t exceed 10 (TEN) hours and Blue Marble Office won’t be responsible for the transaction fee.

The package validity is from the day of the payment until the website is fully created and presented. The project will commence when the payment is placed and the briefing form is received.

The agreement is valid from the first day of payment until two months after the handover occurred.

The package includes in the price:

  • Pages included: five on a predesigned basis template.
  • Basic SEO
  • Analytics integrations
  • Responsiveness to all devices
  • User-friendly templates options.
  • Domain purchase assistance.
  • Branded email addresses
  • SSL certificate
  • The hours of Maintenance after the delivery – within the first two months
  • Bonus: FREE hosting for 1 year.

If anything else is requested, will have separate charges, possibly placed on a separate invoice.

This package does not support changes in the template design, if the Client needs a different design/layout from the ones in Blue Marble Office’s list, the Client might need to change the package to Website development to cover all the possible customizations.

Colors and Fonts can be changed from the original template to adequate to the Client’s branding. However, it is the Client responsibility to communicate the fonts and color codes at the beginning of the project, failing in this communication will result in receiving the site with the default colors and fonts.

The Client will have the responsibility to send all the content, including graphics, correctly labeled in order to start with the project on time and reach deadlines. If the client fails to provide them, this will result in leaving the default content and/or Royalty free images or deleting the entire section without content. 

Blue Marble Office will not be held accountable if delays are from the clients’ end; however, Blue Marble Office will work with you to ensure that deadlines are as achievable as possible.

Please note Blue Marble Office uses Royalty free images in all the predesigned templates; if in any circumstance the Client doesn’t have a picture to provide, then the Client is allowed to use the pictures without giving any credit. However, the picture might be used on other sites and it won’t be unique.

Procedure:
The client will fill in the form of Interest in Blue Marble Office’s site and will receive an email requesting further information. 

Blue Marble Office will schedule a day of delivery according to the Client’s needs and Blue Marble Office load of work. 

Once Blue Marble Office sends the site for reviews and the Client will have 7 (SEVEN) days to send their feedback and request for the three hours of maintenance if needed. If 7 days pass without a response, Blue Marble Office will assume {{client.name}} is happy with the final result and will proceed to invoice the client if any invoices are still pending. 

3 hours of Maintenance are included in the price and the Client has the responsibility to communicate those changes. Once the Client has accepted the job, and the Client still has more time in its favor then the Client is entitled to use it within 2 months from the day of the handover. 

If any other changes are requested after those 3 hours of Maintenance included, extra charges apply.

Termination:
The Client has the right to terminate this Agreement if Blue Marble Office fails to complete the design within 30 days. If the agreement is terminated for any reason other than failure to deliver within this timeframe, Blue Marble Office is not required to reimburse the Client.

If the Client does not purchase a content writer or content research package, the Client will be fully responsible for the content of the website; with no exceptions and it is the Client’s responsibility to deliver it on time. Delays may affect the delivery time of the final result.

If Blue Marble Office designs a website, then the Client agrees that Blue Marble Office may include a development credit and link displayed on the Client’s website. 

During a Website developing project, it is important that the Client communicates information to the Developer to achieve the required result.

The Developer endeavors to create pages that are accessible to search engines. However, the Developer gives no guarantee that the site will become listed with search engines.

Whilst every effort is made to make sure the created website is error-free, the Developer cannot guarantee that the display or functionality of the web design or the website will be uninterrupted or error-free. If, after handover, errors are found on the website the Developer has created and the standard development platform, domain name set-up and hosting set-up are the same as when work began, then the Developer can correct these errors for {{client.name}} free of charge for a period of 2 months, after acceptance of the work. After the 2-month period, the Developer reserves the right to quote separately for any work involved in correcting an error.

In the case the Client specifies a need for the Website that is not possible to achieve with existing Plugins, Blue Marble Office will proceed in the following way:

  1. Inform the Client of the issue and try to present the closer alternative.
  2. Give another idea of how to make it work in some other way.
  3. In the case, the parties can’t reach an agreement and the Client decides to accede to change of coding, Blue Marble Office will get help from the Company associates with an additional cost.

Blue Marble Office will reserve the right not to commence any work until the project has been paid in full.

 

Web development

Validity:

The package validity is from the day of the payment until the website is fully created and presented. The project will commence after 50% of the final invoice is placed and the briefing form is received.

The agreement is valid from the first day of payment until the handover.

Confidentiality
Blue Marble Office will work with you with the highest level of integrity and confidentiality. We ensure that no information is disclosed to any additional parties without prior consent.

All work will be kept on file for a period of 12 months. After this time, work will be deleted unless specifically instructed.

We use encryption services for necessary passwords and any other sensitive data. If the client chooses other distribution methods Blue Marble Office is not responsible for any risks this could entail. 

Deliverability
Blue Marble Office will not be held accountable if delays are from the client’s end; however, Blue Marble Office will work with you to ensure that deadlines are as achievable as possible.

All work conducted by Blue Marble Office will be done Monday to Friday between the hours of 9.00am and 5.00pm (Timezone of Blue Marble Office base). Any work that is required to be conducted outside of these hours will be agreed upon at the time of the contract, and an additional charge of US$2.00 per hour will be added to the per hour prices quoted in the pricing schedule.

Job credits
The client allows Blue Marble Office to add a review (if provided), company logo and any relevant information to Blue Marble Office Website and/or Social Media pages. 

Projects

The client will have the responsibility to send all the content, including graphics, correctly labelled in order to start with the project on time. 

The client agrees that an HTML page built from a graphic design may not exactly match the original design because of the difference between the display in design software and the rendering of HTML code by Internet browser software. Although, the Developer agrees to try to match the design as closely as is possible.

During a Website developing project, it is important that the client communicates information to the Developer to achieve the required result.

The Developer endeavours to create pages that are accessible to search engines. However, the Developer gives no guarantee that the site will become listed with search engines.

Some alterations are included in the price and the client has the responsibility to communicate those changes. Once the client accepted the job, no further changes are acceptable. If any other changes are requested after acceptance of the final design, extra charges apply.

Whilst every effort is made to make sure the created website is error-free, the Developer cannot guarantee that the display or functionality of the web design or the website will be uninterrupted or error-free. Blue Marble Office’s websites are designed with a building add-on called Elementor Pro, the top WordPress website builder. Blue Marble Office provides one year of this powerful tool free of cost. After the first year, the client commits to purchase the license for the website (you can acquire the license HERE). Blue Marble Office commits to sending an email reminder one month before the first year license expires so the client has enough time to make the purchase.

Payment

If 7 days pass without a response, Blue Marble Office will assume the client is happy with the final result and will proceed to invoice if any invoices are still pending.

If the client is not happy with the final result after the rounds of revisions, then the client is entitled to the refund of the deposit, although, transfer fees are not included. 

Quotations are valid for 30 days from the date of issue. If any changes are needed from the client’s end after the quotation, changes in the quote may apply.

  1. Deposit of 50% of the job upfront and balance payable when the job is delivered.
  2. Package payment upfront. In this case, Blue Marble Office will offer as an incentive a 5% discount on the total price of the package. This discount can be accumulated with existing discounts.

If Blue Marble Office builds or amends a website for a Client, then the Client agrees that the Company may include a development credit and link displayed on the Client’s web page, which may be within the code but not displayed on a web browser if requested by the Client.

Web hosting

The Client agrees that if at any time their contact details, including email address, change, it is their responsibility to communicate them to Blue Marble Office to update them. Failure to do so may result in renewal invoices from the domain name and hosting services are not received.

No refunds apply in this package.

Payment for domain name and hosting renewal is to be made within 14 days of receiving an invoice from Blue Marble Office. Failure to comply with the payment terms may result in the Client’s domain name becoming available to another party and/or the website and email services becoming unavailable to the client.

Please note that the general T&Cs applies to this service as well.

Validity
The validity length of this package will be from the day of payment until the design/s are fully created and delivered. 

All the tasks will be performed after the package payment or deposit is made and briefing form received.

The client has the right to terminate this Agreement if Blue Marble Office fails to complete the design within 30 days. If the agreement is terminated for any reason other than failure to deliver within this timeframe, Blue Marble Office is not required to reimburse the client.
 

Concepts: 
Within 3 – 10 business days of receiving your company information and payment, Blue Marble Office will create concepts as stated in the Package inclusions. Designs will be submitted for the client review via E-mail unless otherwise negotiated. Upon receipt of your feedback on these designs, Blue Marble Office will make any needed changes from your selected concept. 
Up to two concepts and three revisions are included in logo designs.

For Branding set:
Up to two concepts and three revisions are included in business cards designs.
Up to two concepts and one revision are included in letter header templates.
Up to two concepts and one revision are included in the branded email signature with 3 variations of signatures.
Up to two concepts, one revision and four different sizes for Social Media platforms for Branded Social Media headers.

Further revisions or concepts will incur additional hourly costs. 

File Delivery: 
After the final design is approved, all variations will be delivered in jpeg and png if nothing else is specified. You will also receive the raw file for future changes.

Delays: 
Injury, theft or other events beyond Blue Marble Office control may result in a delay of unpredictable length.

In the cases where the client pay only the deposit as a first payment, Blue Marble Office will send the concepts and designs with changes with a watermark until the payment is paid in full.

If shorter than 7 business days deadline for a task is requested, additional charges may be applied.

The client has 7 business days to use their right for revisions. If 7 days pass without a response, Blue Marble Office will assume the client is happy with the final result and will proceed to invoice the client, if any invoices are still pending.

Social media

The validity length of this package will be from the day of payment until the last post has been posted according to a schedule, the same will be for this Terms and Conditions Agreement validity.

No refunds will apply in 12 posts Package. 

If 24 hours deadline for a task is requested, additional charges may be applied.

Social media management packages include content creation, edition and image implementation, but it is the client responsibility to provide information to create them.

 

Sales funnels

As results are subject to the Client’s nature of business, audience, target, among others, please note that Blue Marble Office cannot promise any specific results; however, you can request previous results of sales funnels to have an idea of it works. 

Since we request the content for T&C and the Landing page, Blue Marble Office won’t be responsible if information made available on the mentioned sites is not accurate, complete or current. It is the Client responsibility to communicate if any of the content changes and if this happens after the completion of the Funnel and the approval by the Client, extras hourly charges may apply. 

In the cases where the Client pays only the deposit as a first payment, Blue Marble Office will not send a full access to the Sales Funnel until the payment is paid in full.

If shorter than 5 business days deadline for a task is requested, additional charges may be applied.

If Blue Marble Office designs a Landing page, then the client agrees that Blue Marble Office may include a development credit and link displayed on the website. If Blue Marble Office builds or amends a website for a Client, then the Client agrees that Blue Marble Office may include a development credit and/or link displayed on the site, which may be within the code but not displayed on a web browser if requested by the Client. 

 

Email marketing

The validity length of this package will be from the day of payment until the E-mail/s are fully created and delivered to the client as drafts. All the tasks will be performed after the package payment is done and briefing form received.

No refunds will apply in this package.

We use MailChimp for this Service if nothing else requested. If the client does not have an account the client will be asked to get one.

1. General

These Terms and Conditions (“Agreement”) governs the service that is made available by Blue Marble Office. These Terms and Conditions represent the whole agreement and understanding between Blue Marble Office and the individual or entity who subscribes to our service.

PLEASE READ THIS AGREEMENT CAREFULLY. By submitting your application and by your use of the Service, you agree to comply with all of the terms and conditions set out in this Agreement.
Blue Marble Office may terminate your account at any time, with or without notice, for conduct that is in breach of this Agreement, for conduct that Blue Marble Office believes is harmful to its business, or for conduct where the use of the Service is harmful to any other party.

Blue Marble Office may, in its sole discretion, change or modify this Agreement at any time, with or without notice. Such changes or modifications shall be made effective for all Subscribers upon posting of the modified Agreement to this web address (URL): https://www.bluemarbleoffice.com/terms-and-conditions/. You are responsible to read this document from time to time to ensure that your use of the Service remains in compliance with this Agreement.

2. Service Fees / Payments / Invoices
All Blue Marble Office fees and charges are quoted and billed in US Dollars unless otherwise noted before requesting and paying for the service.

Blue Marble Office uses an automated payment processing system and only accepts credit card or PayPal payments at this time. All Subscribers are required to maintain valid payment information on file for the processing of any applicable service fees.

Blue Marble Office may take any reasonable action to validate your payment and registration information and collect all payments due. Service fees are due at the time of order or on the day of renewal. All fees must be paid in full and a month in advance of using the service.

3. Termination / Plan Change / Refund Policy
Blue marble Office reserves the right to terminate the Service after two weeks of fees not being paid without further notice.

You may request account termination or service changes at any time by contacting us. Blue Marble Office will provide said changes for next payment unless otherwise noted.
4. Limitation of Liability
Blue Marble Office is providing a variety of services that will keep your website safe and we will work with you to resolve any issues that may arise. However, in no event will Blue Marble Office be liable to you for any direct, indirect, incidental or consequential damages or economic loss in connection with your website or any other services provided to you.

If nothing else is specified we perform backups of your website daily, if you request a website restoration we do not guarantee all information are saved.

In the unlikely event of your website breaking, we include three hours each month to fix the issue. These hours are not, however, for design changes or any other adjustments. These hours are also not included if the issue was caused by negligence from the client or any third party side.
